Subject-To Deals in Las Vegas: What Every Seller Must Know Before Signing
If an investor has offered to buy your Las Vegas home by taking over your existing mortgage payments, you have been pitched a subject-to deal. These offers are everywhere right now, especially for homeowners with low interest rates, thin equity, or a hardship situation. Before you sign anything, you need to understand exactly what you are agreeing to, because in a subject-to sale, the risk does not leave when the keys do.
What Subject-To Actually Means
In a subject-to transaction, you deed the property to the buyer, but your mortgage stays in place and stays in your name. The buyer takes over making the payments, but they never formally assume the loan and the lender never approves the transfer. You give up ownership of the house while remaining legally responsible for the debt attached to it.
Investors love this structure in the current market for one simple reason. If you locked in a 3 percent rate a few years ago, that loan is worth keeping alive. Rather than paying it off with expensive new financing, the buyer rides your cheap debt, often while putting very little money into the deal.
The Risks Sellers Carry After Closing
First, the loan remains on your credit. If the buyer stops paying, the late payments and any foreclosure land on your credit report, not theirs. You could suffer a foreclosure on a house you no longer own and have no legal right to control.
Second, that mortgage still counts against your debt-to-income ratio. If you plan to buy your next home in Summerlin, Henderson, or anywhere else, most lenders will treat that payment as your obligation, which can block your next purchase for years.
Third, nearly every mortgage contains a due-on-sale clause. This gives the lender the right to demand the entire balance the moment title transfers. Lenders rarely enforce it while payments arrive on time, but the right exists, and if it is exercised, the loan in your name comes due in full.
When It Can Make Sense, and What Protection Looks Like
Subject-to is a legitimate strategy with a long history, and for some sellers with little equity who need out fast, it can beat the alternatives. But a legitimate deal has specific ingredients: a real estate attorney reviewing the documents, closing through a licensed Nevada title and escrow company, third-party loan servicing so payments are tracked independently, and full written disclosure of every risk described above. If the buyer resists any of those, walk away.
